Drink and Drug impaired driving

Drink driving is technically called "driving with excess breath/blood alcohol or EBA".   
Alcohol and drug affected driving are serious offences and carry tough penalties, especially for repeat offenders. If you are convicted of a third or subsequent offence you face a maximum fine of $6000, or a prison term of up to two years, and a one year minimum disqualification from driving. If you cause injury or death, you can be fined up to $10,000 for driving carelessly while under the influence of alcohol or drugs or could be sentenced to prison.


Careless, Reckless or Dangerous Driving

If you are found guilty of dangerous driving then, except in very special circumstances, you must be disqualified for a mandatory period of six months. If you are caught driving at a very excessive speed you might be charged with either driving at a dangerous speed or driving in a dangerous manner or reckless driving. All of these offences are serious and carry a potential sentence of three months imprisonment and a minimum mandatory period of disqualification of six months.


Limited (work) licences

Losing your driver's licence as a result of a disqualification or demerit point suspension can result in extreme hardship particularly if it impacts on your ability to work. In some circumstances a Limited Licence can be obtained to relieve that hardship. Of course, not all people will qualify for a Limited License as there are some restrictions depending on your conviction history and the circumstances and nature of disqualification.

Speeding offences

In many instances exceeding the speed limit will result in a hefty fine. However, if you exceed the speed limit by more than 40km/hr will result in immediate loss of licence and often a further charge of dangerous of dangerous, reckless or careless driving which will result in immediate suspension and a criminal charge. Accumulation of demerit points for traffic infringements will also result in suspension of license.
