Drafting your Will

The key people involved in a Will are:
  • The Will-maker / Testator / Testatrix -  the creator of the Will and owner of the assets;
  • The Executors and Trustees – the people who are in charge of attending to the effecting of the Will-maker’s wishes and distribution of the deceased’s estate;
  • The Beneficiaries – the individuals who will receive the benefit of the assets in the deceased’s estate.

We advise our clients to review their Will on a regular basis so that it remains up-to-date according to your wishes.

Please find below a link to a form which we provide for our clients to print off, fill in, and either bring with you to an appointment with us to discuss the contents of your Will, or alternatively depending on your busy schedule you may prefer to send the completed form to us. We will then provide you with a draft Will which can be finalised by correspondence so that you are only required to come into our office to sign and execute the Will.

Enduring Powers of Attorney (EPA)

The electing and authorising of trusted people to be legally responsible for decisions relating to your personal care and welfare and your property matters, at a time when you do not hold the mental capacity to make these decisions yourself is on a similar scale of importance as executing a formal Will.

At Layburn Hodgins, our solicitors challenge themselves with the important question of “What if?” and advise in particular our elderly clients of the importance of executing Enduring Powers of Attorney.  An EPA would step into play if a client had an accident, illness, or purely because of old age became unable to make proper decisions for their personal care and welfare and/or their property and assets.

However, it is not just our elderly clients who benefit from this service. For people who are planning on travelling overseas, authorising a trusted person with the responsibility of making decisions and signing off on behalf of you with respect to your property and assets is extremely helpful.

Claims against Estates

Layburn Hodgins can act either for claimants and their rights to a share in an estate, or for the deceased’s estate, against claimants.
