Credit Policy

Purpose

1. You may use Paystation for the purposes of making payments to Layburn Hodgins for the purpose of paying your retainer and paying your invoice, provided that you do not:

  1.1. In any way damage or disrupt the services/operation of Paystation.

  1.2. Use Paystation for any unauthorised or unlawful purpose.

Your Warranties

2. You warrant that:

  2.1. You are aged 18 or over

  2.2. You have the appropriate authority to validly accept the Online payment terms and are able to and will meet your obligations in relation to these terms.

  2.3. The credit card used in connection with Paystation is issued in your name.

  2.4. You will pay the credit card issuer all charges incurred in the use Paystation.

  2.5. The information supplied by you is true and correct.

Payment

3. You can make payments to us using any Visa and Mastercard credit cards.

4. All charges are in New Zealand Dollars and inclusive of GST (if any).

5. Part payment of your invoice is acceptable provided the full payment is made by the due date stated on your invoice.

6. All payment of retainers must be paid in full and by no later than the final date for payment set out in the invoice/notice.

7. Upon completing a transaction using Paystation, you will be presented with a confirmation screen verifying the transaction information you wish to process. It is your responsibility to verify that all transaction information and other details are correct. Layburn Hodgins shall have no liability for transactions which are incorrect as a result of inaccurate data or information entry in the course of the use of Paystation or for loss of data or information caused by factors beyond Layburn Hodgins’ control.

8. Once a payment has been made it cannot be cancelled.

9. Layburn Hodgins accepts no responsibility for refusal or reversal of payments, which shall be a matter between you and your credit card provider.

10. Payments made using Paystation are made through a secure third party website. However, you acknowledge and agree that Internet transmissions cannot be guaranteed to be entirely secure or private and any information provided by you (including credit card details) may be able to be read and/or intercepted by a third party. Layburn Hodgins shall have no liability for the interception and/or ‘hacking’ of any data or other unauthorised access to information provided by you when using Paystation.

Exclusion/Limitation of Layburn Hodgins Liability

11. To the full extent permitted by law, Layburn Hodgins does not accept liability for any damage, loss, costs (including legal costs), expense, indirect or consequential losses or damages of any kind which may be suffered or incurred by you from the use of Paystation, if, for any reason, Layburn Hodgins is found to be liable to you for any damage or loss which arises as a result of your use of Paystation, Layburn Hodgins liability shall be limited to the amount paid by you through Paystation or $100, whichever is the lesser.

Consumer Guarantees Act 1993

12. If the Consumer Guarantees Act 1993 applies to your use of Paystation and you may have rights or remedies that are not excluded or limited by clause 11. If you are using the services for business purposes, the exclusions and limitations set out in clause 11 will apply and the provisions of the Consumer Guarantees Act 1993 are hereby excluded.

Use/Availability of Paystation

13. Layburn Hodgins does not warrant or guarantee that Paystation and/or your use of Paystation will be error free, immediate, virus free and/or continuously available or that the information provided through Paystation will be complete, accurate and/or up-to- date.

14. Layburn Hodgins reserves the right to suspend, amend or cancel Paystation at any time either temporarily or permanently.

Website Terms and Conditions

15. These Terms form part of the Layburn Hodgins Terms of Engagement, Conduct and Client Care (Ts & Cs), which apply to general Layburn Hodgins website usage. By agreeing to comply with these terms you also agree to comply with Layburn Hodgins Ts & Cs. If there is a conflict between the Layburn Hodgins Ts & Cs these Terms, shall prevail.

Indemnity

16. You agree to indemnify Layburn Hodgins for any loss, cost or expense suffered or incurred by Layburn Hodgins as result of:

16.1. Your breach of your obligations under these Terms.

16.2. Your intentional misuse of Paystation.

16.3. Your negligent acts or omissions.

16.4 Any claim brought against Layburn Hodgins by a third party in relation to your use of Paystation.

Governing Law

17. These Terms are governed by New Zealand Law. The New Zealand Courts have exclusive jurisdiction over any matter in connection with Paystation and these Online payment items.

Credit Card Online Merchant Service Fee

There is a 3.10% (of the amount you pay via Paystation) merchant service fee, per transaction for credit card payments. This is an ANZ charge and is subject to change.

Security

Your payment details have the security offered by Paystation, a fully PCI DSS compliant certified Solutions Provider.

Other Fees

Check with your credit card provider for any other fees or charges that may apply. This transaction is carried out on the terms of the arrangement between you and your credit card provider.

Currency Conversion

Your account will be charged in New Zealand Dollars. If you make a payment with a credit card issued outside of New Zealand, any currency conversion will be in accordance with the terms and conditions of that card. Your card issuer may charge currency conversion fees.

Payment Confirmation

We will email you a payment confirmation upon request only if you provide an email address.
